This website www.borovitzawinery.com is property of the Borovitsa winery, and the online store is managed by “Win” EOOD in its quality of an exclusive sales representative of the winery. These General Terms and Conditions regulate the relationship between the supplier “Win” EOOD and consumers, buyers of goods , which are offered on the website www.borovitzawinery.com, by means of a sales contract concluded between the parties.
“UIN” EOOD provides the client with the opportunity to purchase the wines and other items offered through the online store by means of a purchase request and payment of the relevant sales price, subject to the client’s compliance with these General Terms and Conditions. The customer can make requests to purchase the products offered through the online store only after expressing agreement with these General Terms and Conditions, by which he is considered bound by the terms of the General Terms and undertakes to comply with them. “WIN” EOOD reserves the right to change these General Terms and Conditions at any time, promptly publishing these changes on the website www.borovitzawinery.com.
“UIN” EOOD tries to maintain on the site true, accurate and up-to-date information about all products. However, it does not exclude the possibility of errors, inaccuracies or omissions, due to technical or human factors, and assumes no responsibility in this regard.
“UIN” Ltd. does not guarantee that access to the online store will be uninterrupted, timely, secure and error-free, to the extent that this is beyond the capabilities and control of “UIN” Ltd. “UIN” EOOD is not responsible for not providing access to www.borovitzawinery.com, as well as for not processing or untimely processing of purchase requests, in the event of circumstances beyond its control – cases of force majeure, random events and problems in the global network (internet).
“UIN” EOOD reserves the right to change prices without notifying its users, as well as to correct errors/inaccuracies in product information. Typographical errors, color rendering differences, and product design changes are possible.

3. Orders/Purchase Requests
To purchase wine through www.borovitzawinery.com, the customer can register or order as a guest, and before completing the last step of the ordering process, the customer must agree to these Terms and Conditions.
Registration on the site
The customer provides the following information for the purposes of registration: for individuals – name, surname, telephone, e-mail address; shipping address; for legal entities– trading company, telephone, e-mail address, address, VAT Number, contact person. The customer guarantees that the data he provides when filling out the registration form is true, complete and accurate.
Agreement to the General Terms and Conditions
By pressing the virtual “Order” button, the customer makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that he is familiar with these General Terms and Conditions, accepts them and undertakes to comply with them.
Each purchase request from the Customer through www.borovitzawinery.com, based on these General Terms and Conditions, is submitted and carried out in fulfillment of the contract of sale between the parties. In the case of a dispute whose will is to be bound by the text of these General Terms and Conditions, the person who paid the price of the products requested for purchase is considered a party to the contract.
Acceptance of the order/request
The request to purchase goods through www.borovitzawinery.com is considered to be made after pressing the “Order” button. If an incomplete, incorrect or wrong address and/or phone number is specified when submitting the order/request, it is considered invalid and www.borovitzawinery.com is not obligated to fulfill it.
The purchase request is accepted by www.borovitzawinery.com by sending a confirmation to the Customer’s e-mail address, containing the main information about the order: customer, address, e-mail address of ordered products, their selling price, the value of postal or transport costs , not included in the sales price and related to its delivery, the payment method chosen by the Customer, the specified invoice data and delivery address.
4. Delivery
The goods requested for purchase are delivered to the delivery address specified by the customer within 1 (one) to 3 (three) working days.
For orders over BGN 90, delivery is free, for orders under BGN 90 a fixed delivery price of BGN 6.00 applies.
We strive to maintain up-to-date availability of all products on the www.borovitzawinery.com site. However, in some cases, we may not have the item you requested in stock for various reasons. If such a situation arises, we will contact you on the phone or email indicated in your order to offer you another product or, if you do not want another product, we will refund the full amount of the payment you made in case you used a card .
When wines from a given harvest run out, wines from the next are delivered. We take care to reflect such changes in the wine information on the site, but on rare occasions there may be differences between the harvest reflected on the site and the one we deliver to you.
The goods are delivered appropriately packed, according to their type and the transport for delivery.
The wine is handed over to the customer or a third adult, who accepts and confirms receipt by signing the accompanying documents. The wine can only be handed over to an adult, who is established at the time of delivery. If a minor is found to be the recipient of the shipment, it will be returned, and the delivery costs will be borne by the customer.
In the event that the customer is not found within the delivery period at the address specified by him or access and conditions for delivery of the products are not provided within this period, the ordered items are returned to the warehouse. The customer can confirm his desire to receive the items even after the expiry of the delivery period, in which he was not found at the address, by bearing the costs of re-delivery. In this case, a new delivery period starts from the moment of confirmation according to the previous sentence.
5. Prices and payment methods
All prices of goods in the www.borovitzawinery.com online store are in Bulgarian levs, including VAT.

6. Termination of a wine club subscription:
You may terminate your wine club membership at any time by sending written notice to info@borovitzawinery.com. Your feedback is extremely important to us. We would appreciate it if you could let us know what caused you to cancel your membership.
Your subscription payment is based on 6 months. At the time of cancellation, we will calculate whether the amount paid by you corresponds to the debts received up to the time of cancellation. In case the amount paid exceeds the goods received, we will offer you promotional vouchers with which you can purchase wines from our online store.
7. Customer rigths
A customer who is a consumer within the meaning of the Consumer Protection Act has the right, without owing compensation or penalty and without giving any reason, to withdraw from the concluded contract for the purchase of goods through www.borovitzawinery.com by returning the goods to a period of 14 (fourteen) working days, counted from the date of its receipt. In the event that the Customer withdraws from the concluded contract within the period of the previous sentence, he should send a statement of withdrawal from the concluded contract to www.borovitzawinery.com and return the goods in undamaged integrity and in good commercial condition. The opt-out statement should be sent to the e-mail address info@borovitzawinery.com.

We accept claims within 30 days of receipt of delivery. If you have a problem with the quality of the wine (it is defective or spoiled), we will accept it back, including after the 30-day period has expired, but within reasonable storage (we cannot accept white wine that is 5 years old, for example).
In the cases listed above, you can request that the delivered product be replaced with one corresponding to the one you ordered by sending a written request to info@borovitzawinery.com. In the event that the items for which the exchange is made exceed the value of the original order, you must pay the difference, and in the case of a lower value, we will provide you with vouchers for a discount on your next purchase from our site.
In the event that you do not wish to replace the items you are returning, we undertake to refund in full the sums paid by you no later than 15 (fifteen) working days from the date on which the customer has exercised any of his rights to refusal.
